ABA program gives candid insights regarding what appellate judges want to see in briefs

At the ABA’s recent Midyear Meeting in New Orleans, the Council of Appellate Lawyers sponsored a panel discussion on appellate brief writing. The panel members included Judge N. Randy Smith of the Ninth Circuit, Justice Bernette Johnson of the Louisiana Supreme Court, and experienced Texas appellate lawyer Roger Townsend of Alexander, Dubose & Townsend in Houston. Horvitz & Levy partner Mitch Tilner acted as the panel’s moderator. Robert Thomas, a Hawaii land-use and appellate lawyer who maintains the blog inversecondemnation.com, attended the program and tweeted observations throughout. He then re-posted them here on his blog. Members of the Council will have access to an audio recording of the program through the Council’s website. (Full disclosure: As Chair of the Council’s Programs Committee, I helped to organize the panel.)
