Tyler Pialet reports in the Daily Journal about People v. McDaniel, the death penalty appeal in which the Supreme Court six months ago asked for supplemental briefing on systemic issues the court has consistently decided against condemned defendants (most recently, here).
The article says, “The request for additional briefing on those questions and the responses the court has received illuminate what some attorneys say may be a cultural shift in the capital punishment debate in California, fueled by the rise of the so-called progressive prosecutor movement and enabled by a governor who is opposed to the death penalty.”
