A Judicial Council news release reports, “The Supreme Court Committee on Judicial Ethics Opinions (CJEO) today posted a summary of oral advice stating appellate justices should disqualify themselves from a case if they were removed by peremptory challenge while hearing the case as a trial judge.”  (Link added.)  The summary says that it is “advisory only” and does “not necessarily reflect the views of the California Supreme Court or any other entity.”

This advice is mostly academic for the current Supreme Court.  Only three of the justices ever served as trial judges and none more recently than 15 years ago.
