On Monday morning, the Supreme Court will file its opinion in Noel v. Thrifty Payless, Inc. (Briefs here, including six amicus curiae briefs; oral argument video here.)
Noel is the last undecided early-May calendar case. There are still 15 cases in the forthcoming-opinion pipeline, from the late-May and June calendars.
Noel will address the issue whether a plaintiff seeking class certification under Code of Civil Procedure section 382 or the Consumer Legal Remedies Act must demonstrate that records exist permitting the identification of class members. The court granted review in February 2018.
