On Monday morning, the Supreme Court will file its opinion in Travis v. Brand. (Briefs here; oral argument video here.)

This will be the first opinion in any of the four cases argued on the December calendar. The filing comes with over a month left in the 90-day period; that’s faster than what has become the norm. Opinions in the other three December cases should file by March 6.

Travis is expected to decide whether a prevailing defendant in an action under the Political Reform Act of 1974 (Gov. Code, § 81000 et seq.) must show that the case was frivolous, unreasonable, or without foundation in order to recover attorney fees. At stake in this particular case is a fee award of over $800,000. The court granted review in June 2021.
