Today’s unanimous opinion in California Medical Association v. Aetna Health of California, Inc. (update: see here) is authored by Justice Kelli Evans and is her first opinion for the Supreme Court. She issued a two-justice dissent last month.
The CMA opinion comes six months after Justice Evans was sworn in. That’s a faster-than-average first opinion for a new justice, at least in recent times. (See here.)
As for one style point, the opinion leaves Justice Goodwin Liu as the lone member of the court who won’t use footnotes. Today’s 37-page opinion has 10 footnotes.
