Ninth Circuit grants habeas relief to inmate whose death sentence the Supreme Court affirmed

Following concessions by California’s Attorney General, an en banc Ninth Circuit yesterday ordered a death row inmate released unless the state retries him.  The brief unsigned order is followed by two concurrences and one judge’s dissent.
