On Monday morning, the Supreme Court will file its opinion in People v. McDavid. (Briefs here; oral argument video here.)

McDavid is expected to decide whether the trial court has discretion to strike a firearm enhancement imposed under Penal Code section 12022.53 and instead impose a lesser uncharged firearm enhancement under a different statute (Pen. Code, § 12022.5). The court granted review in September 2022. More about the case here.

This will be the third of four opinions for cases argued in February. The last case — People v. Flores, a Fourth Amendment detention appeal in which the dissenting Court of Appeal justice cited “#BlackLivesMatter” — should be decided by May 6. Additional argued but undecided cases are the six from the March calendar (opinions expected by June 3) and the six on the April calendar (opinions expected by July 1).
