The following is our summary of the Supreme Court’s actions on petitions for review in civil cases from the Court’s conference on Wednesday, July 20, 2011. In re Lamps Plus Overtime Cases, S194064—Review Granted and Held—July 20, 2011
The court ordered briefing deferred pending consideration and disposition of the related case of Brinker Restaurant v. Superior Court, S16635, which presents issues concerning the proper interpretation of California’s statutes and regulations governing an employer’s duty to provide meal and rest breaks to hourly workers.
As we noted yesterday, the lead case — Brinker — has been pending for quite some time. Indeed, review was granted in In re Lamps Plus two years to the day after the reply brief was filed in Brinker.
