On Monday morning, the Supreme Court will file its opinion in In re Christopher L. (Briefs here; oral argument video here.) This will be the second of three opinions in cases on the February calendar. The opinion in the third case should file by May 2.

Court of Appeal justices are sitting pro tem on the February cases in place of Justice Mariano-Florentino Cuéllar, who left the court at the end of October and wasn’t replaced until the end of March.

When it granted review in February 2021, the court limited review in Christopher L. to: “Is it structural error, and thus reversible per se, for a juvenile court to proceed with jurisdiction and disposition hearings without an incarcerated parent’s presence and without appointing the parent an attorney?” Fifth District Justice Rosendo Peña, Jr., is the pro tem.

The opinion can be viewed Monday starting at 10:00 a.m.
