On Monday morning, the Supreme Court will file its opinion in People v. Braden. (Briefs here; oral argument video here.)

This will be the last opinion in the four March calendar cases. A decision in one last February case — the death penalty appeal in People v. Wilson — isn’t due until June 15 because of post-argument supplemental briefing. Opinions in five remaining undecided April calendar cases are due by July 3.

When the court granted review in Braden in July 2021, it limited the issue to:  “What is the latest point at which a defendant’s request for mental health diversion is timely under Penal Code section 1001.36?”  (Link added.)
